Terms of Service

These terms have not yet been reviewed by a lawyer. They describe how we intend to operate, and we will post a reviewed version here when one is ready.

These Terms of Service (“Terms”) govern your access to and use of Infacta Account, the central account and club-management service for Infacta products. Infacta Account is operated by Groupmail Ltd. trading as Infacta (registered in Ireland, company no. 284930, registered office Unit 15, SocoLab, Strandhill, Co. Sligo, F91 E426, Ireland) (“Infacta”, “we”, “us”). By using the service, you agree to these Terms.

Who can use Infacta Account

To hold an Infacta account you must be at least 18 years old. If you manage a club, society or organisation (your “Club”) here, you must be authorised to act on its behalf. You agree to give accurate account information and to keep it up to date.

Infacta products are currently invite-only: club accounts are created by us, and you join a club by invitation from its admins.

One account for every Infacta product

Your Infacta account is the identity you use across Infacta products (such as ClubCards and FloorTime). Signing in to a product signs you in with this account, and the clubs, roles and access managed here determine what you can do there. Each product also has its own terms, which apply alongside these when you use it.

Accounts and security

You are responsible for activity under your account and for keeping your credentials secret. Tell us promptly if you believe your account has been compromised.

Within a Club, owners and admins control who is invited, the roles people hold and the products they can access. The Club is responsible for who it invites and what access it grants.

The service

Infacta Account is the central account and club-management service for Infacta products: sign-in, your profile, your clubs and their people, invitations, roles and product access, and your club’s shared identity (name, crest and colours) which the products inherit.

We may add, change or remove features over time, and we may set reasonable limits on use of the service.

Your data and the people you add

You are responsible for the information your Club enters, including the personal data of the people you invite. By adding someone, you confirm you have the right to do so.

Our Privacy Policy explains how personal data is handled, including what is shared with the Infacta products your clubs use.

Infacta Account is provided free of charge. Individual Infacta products may have their own fees, set out in their own terms.

Third-party services

Some features rely on third parties — including hosting and email delivery. Those services are subject to their own terms, and their availability is outside our control.

Intellectual property

We own the Infacta platform, software and brand. Your Club keeps ownership of its name, crest, colours and the data it enters. You grant us a limited licence to host, display and process that content only as needed to provide the service — including showing your Club’s identity in the Infacta products it uses.

Suspension and termination

You can stop using the service at any time. Because this account signs you in to every Infacta product, closing it ends your access to those products too. We may suspend or terminate an account that breaches these Terms or that creates a security, legal or operational risk. On termination we may delete account data, subject to our Privacy Policy and applicable law.

Disclaimers

The service is provided “as is” and “as available”. To the extent permitted by law, we make no warranties that it will be uninterrupted, error-free or fit for a particular purpose.

Limitation of liability

To the maximum extent permitted by law, Infacta is not liable for indirect, incidental or consequential loss, or for loss arising from a Club’s own data or decisions — including who a Club invites and the access it grants. Nothing in these Terms limits any liability that cannot be limited by law.

Changes to these Terms

We may update these Terms from time to time. If we make a material change we will give reasonable notice. Continuing to use the service after a change takes effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction over any dispute, without affecting any mandatory consumer protections available to you locally.
